Because Toby Tate died instantly, investigators knew she couldn’t have made it into the back of her van on her own. They believe the suspect pulled her from the driver’s seat into the cargo area, and dropped something along the way. A cigarette was found next to Toby’s body, and she wasn’t a smoker.
There was no sign of sexual assault, but Toby’s wallet and the camera her family said she had with her were missing. The theory at the time was that this was a robbery, and moving her body bought the suspect time.
A van that looked like it had been in a minor accident would draw far less attention than a woman slumped over in the driver’s seat.
