Republican Rep. Jim Jordan, chair of the House Judiciary Committee, on Wednesday night asked the Justice Department to consider criminally charging special counsel Jack Smith, who previously prosecuted President Donald Trump, according to a letter sent to DOJ obtained by CNN.

Jordan alleges Smith misled the committee in closed-door testimony late last year. Jordan’s concerns are largely based around Smith’s team of prosecutors obtaining text messages between Trump administration officials and members of Congress in their investigation of Trump and his top aides’ response to his 2020 election loss, according to the criminal referral letter Jordan sent to DOJ.

CNN senior legal analyst Elie Honig and former federal prosecutor Mike Gordon weigh in on the legal challenge facing Smith.

    Poor Jack Smith never expected that question UNDER OATH from Congress about Texts, Bravo to ask him that, they knew what he had illegally done…and you can see the ole ugly Jacky lying answering it… his Karma has finally arrived, How does it feel to be on the other side???… That vermin criminal Smith is NOT above the law.

      But he answered the question truthfully. Listen to the questions, and listen to the answers. He did not have to request the contents of the messages from Congress — he got the contents from NARA, available there as White House records.

      ​@bmjpdx9222 not true and actually besides lying about the texts, Smith even requesting Congress phones records was illegal, there is a law in place that he violated, he lied about the texts, ANY texts….Trying to use the ole Bill Clinton defense “depends on what is, is” when he lied under oath about Monica Lewinsky…Smith Trying to distort the meaning, of a question like Clinton, didn’t work for Clinton, he still got impeached.

    Elie Honig has it wrong: Smith was not asked if he had *seen* the contents of text messages, he was asked if the records he requested included the contents.

    Grassley showed the truth there were 44 text messages involving members, when Smith in an inquiry that was the case.Just another member of the Biden weaponization of the justice system. Whose sole task was to get Trump by any means dirty or otherwise to get Trump and GOP members .Smith deeply involved in the Mar-a-Lago raid fiasco,

    No one can be charged for perjury, when there is no perjury. Smith can’t be charged for what he wasn’t ask. The GOP is acting very malign. Another case that will only degrade the DOJ
