Pls note that the cookbook author has withdrawn her demand and apologized, so let’s not pile on. This was just a good opportunity to share some legal info on something widely misunderstood. Personally, I don’t think it’s very nice to take credit for recipes that you “borrow” from someone else (which didn’t even happen here, making the claim all the more specious from the get-go), but from a legal POV, it really amounts to nothing. This is why even though it has happened to me a LOT, I never make a stink about it. Once, someone used AI to make an entire cookbook called “The Korean Vegan Cookbook” and the only reason I was able to get it taken down was b/c it copied my table of contents (curation of recipes IS copyrightable). Keep that in mind the next time you get angry when someone accuses another of “stealing“ their one of a kind recipe! #randomlawthings #law #cakepop

I worked at a restaurant and then later opened one, I had a sauce with a similar name and the first restaurant tried to sue me because they thought I used their sauce recipe. I didn’t. But my lawyer was like ya, they can’t sue you for copywrite infringement either way.
I always assumed that if something is published, and therefore out in the world, then its a free for all….
