New York just declared war on the prediction market industry, and this time the target is fighting back hard. Attorney General Letitia James filed suit against Polymarket, the prediction market platform, for the second time in two months that New York has taken legal action against a company in this space. The state is calling Polymarket an unlicensed gambling operation that allows New Yorkers as young as 18 years old to bet on sports, elections and major world events without holding a state gambling license of any kind. New York is seeking to have Polymarket banned from operating in the state entirely, along with fines of $100,000 for every single unauthorized sports wager ever offered to a New York resident, plus three times all company gains derived from New York users. The response from Polymarket was swift and aggressive. Within hours of the state’s lawsuit being filed, Polymarket turned around and filed its own lawsuit against New York state and its Gaming Commission in federal court. Their argument is direct — the state of New York has no authority whatsoever to regulate them, because Polymarket operates as a federally licensed exchange regulated by the Commodity Futures Trading Commission, and federal jurisdiction supersedes state authority. It is the exact same legal argument being made by Kalshi, the other prediction market platform that New York sued back in July. And it sets up a legal confrontation with genuinely enormous stakes. The core question at the heart of both cases is one that courts have not yet definitively answered — does a state have the legal power to shut down and penalize a federally regulated platform that the state considers to be gambling? Whatever answer the courts ultimately reach could reshape the entire prediction market industry and directly affect millions of users across the country.
