Young adults between the ages of 18 and 21, who are legally prohibited from sports betting in most US states, have bet an estimated $5.4 billion on the Kalshi prediction market so far in 2026. Five point four billion dollars. The vast majority of it, $3.9 billion, went directly on sports bets and parlays. So how is this legally possible when most states set the minimum gambling age at 21? The answer is a loophole that the gambling industry is furious about. Kalshi operates not as a state-regulated gambling platform but as a federally regulated financial exchange, which means it falls under the rules of the Commodity Futures Trading Commission rather than state gambling laws. The CFTC allows anyone 18 and older to trade on its regulated exchanges. So while a 19-year-old cannot legally walk into a Las Vegas sportsbook or open a DraftKings account in most states, they can open a Kalshi account on their phone right now today and bet on the NFL without breaking any federal law. Forty-four state attorneys general, dozens of Indian tribes, and the entire casino industry are currently in court fighting to close this loophole before the NFL season opens on September 10th — just nine days away. Kalshi maintains that its platform is a legitimate financial exchange and fundamentally different from gambling. The American Gaming Association calls it a backdoor into sports betting. With the NFL season days away, the numbers from 18-to-21-year-olds on Kalshi are expected to surge even further.
