Hans Hamilton was driving when he saw what appeared to be a car accident and the driver passed out on the grass. When Hamilton pulled over to help the man, the man leaped up and smashed the good Samaritan’s windshield. The man also repeatedly punched Hamilton. Hamilton spoke with Inside Edition. He says he is convinced the driver he went to help was trying to lure him into a trap. Cops say Daniel Coman has been charged with battery and assaulting a deputy sheriff who pulled up to the crash site.
Hamilton set up a GoFundMe to help with recovery costs. For further information about his GoFundMes, click this link: https://www.gofundme.com/f/help-hans-recover-after-attack

1) _”Battery (crime) is unwanted-or-harmful physical contact upon another person. Causing another person to fear physical harm is assault (crime) and doesn’t require successful physical contact.”_
2) _”In most U.S. jurisdictions, there is no general legal duty to rescue, meaning a person can legally refuse to act unless they created the danger, have a special relationship with the victim (e.g., parent-child), or have initiated a rescue. When a duty does exist, refusal is only legally justified if the rescue attempt poses a significant risk of death or serious injury to the rescuer.”_
3) _”A person cannot be legally forced to risk their own life or safety to rescue anyone, including a previous attacker, even if a “duty to rescue” exists in that jurisdiction. Legal obligations to assist only require reasonable actions that do not put the rescuer in danger.”_
